Kasian Architecture Interior Design and Planning Ltd. (“Kasian”) Use of Instruments of Service Agreement

All drawings, plans, models, specifications, reports, electronic data files, working digital records (CAD Files) and all other documents (whether in graphic, written or electronic form), prepared by or on behalf of Kasian Architecture Inc.,  Kasian Architecture Interior Design and Planning Ltd. and/or their affiliates, subsidiaries, successors and assigns (hereinafter “Kasian”), are Instruments of Service (“IOS”) and, unless otherwise agreed to in writing, Kasian hereby retains all common law, statutory and other rights related thereto, including but not limited to copyrights, trademarks and design rights with respect thereto.

Kasian’s IOS are developed for the exclusive use of its clients and those project team participants of Kasian’s clients which are approved by Kasian from time to time in writing. Kasian’s IOS are to be used exclusively for the particular project for which they were developed and shall not, unless otherwise agreed to in writing by Kasian, be used for any additions or alterations to such project nor shall they be used on any other project without prior written authorization of Kasian. If you have received this e-mail message in error, it is strictly prohibited for you to view, copy, distribute or disseminate Kasian’s IOS. Please promptly and permanently delete this e-mail message from your system.

Due to the unsecured nature of electronic data transfer and the inability of the originator to establish controls over the use thereof by the user, unless otherwise agreed to in writing by Kasian, Kasian assumes no responsibility for any damages, errors, or omissions, indirect, consequential or otherwise, arising from use of Kasian’s IOS. Hard copy/paper copy IOS takes precedence over any electronic format IOS unless otherwise agreed to by Kasian in writing. In the event that Kasian’s IOS are used for purposes other than intended or permitted in writing by Kasian, or if Kasian’s IOS are amended, altered or revised in any manner whatsoever, without receiving Kasian’s prior written consent, anyone improperly using this information does so at their own risk. Accessing Kasian’s IOS provided herein, confirms acceptance of all conditions of use provided herein and the user agrees to indemnify, hold harmless and defend Kasian from and against all claims, demands, losses, damages, liability, and costs (including solicitor client costs) arising from such use.
